Enforcement of the Revised Act Against Misleading Representation in Japan from Dec.1, '14


Fine for false representation of foods & services (3% of sales amount)will start around 2015


According to the revised act, sellers will be punished, if they engage in the following illegal activities:

# Representations of products or services that are much better than the actual ones or of competitors

# Representations of products or services that are much more beneficial to consumers than the actual ones or those of competitors

# Claims about products or services that are not backed by evidence/data that are likely to be misunderstood by general
(eg. bait-and-switch selling)

Fine for misrepresentation:
  

The fine for misrepresentation will be set within one year from now.
According to the current draft, when products/services post sales above 50 million yen, the seller is required to pay 3% of the sales by the Japanese Consumer Affairs Agency.
